2. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
If you create an account, you agree to provide accurate information and keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

3. Orders, Acceptance & Contract Formation

All orders are subject to acceptance by GL Planters. An order is an offer to purchase. We may accept your order by sending an order confirmation or by shipping the products. The contract is formed when we send the order confirmation or ship the products, whichever occurs first.

We reserve the right to refuse or cancel any order for any reason, including pricing or inventory errors, suspected fraud, or inability to obtain authorization for payment.

4. Pricing, Taxes & Payment

Prices are shown in USD unless otherwise stated and may change at any time.
You are responsible for applicable sales tax as determined at checkout.
Payment is due at the time of purchase. We accept the payment methods displayed at checkout.
Payments may be processed by third-party payment processors; their terms may apply.

5. Shipping, Delivery & Risk of Loss

Shipping timelines shown on the Site are estimates and not guaranteed. Title and risk of loss pass to you when the carrier accepts the shipment.

Tracking notifications: We and/or shipping carriers (such as UPS and FedEx) may send shipping and delivery notifications (including tracking numbers) to the email address and/or phone number you provide at checkout.

If you receive a shipment that is damaged or missing items, please contact us via our Contact page within 7 days of delivery and we will work with you to make it right. Keep packaging and take photos of damage when possible; we may assist with carrier claims.

6. Returns, Refunds & Warranty

Our Refund & Return Policy and Shipping & Warranty policy are incorporated into these Terms by reference and govern returns, refunds, exchanges, shipping details, and warranty coverage:

Key return eligibility highlights: Returns/exchanges are generally available within 30 days for eligible items. Returned items must be in original condition and packaging with all parts included. For planters, eligibility requires that soil has not been added and the original box and all pieces are returned. Final sale/clearance items and custom modifications/custom orders are not eligible unless defective. Return shipping and non-refundable delivery costs remain the customer’s responsibility unless the return is due to our error. See the Refund & Return Policy for full details.

Limited Warranty: GL Planters products may be covered by a limited warranty (currently 13 months / 1 year and 1 month from purchase for planters). Warranty terms, coverage, exclusions, and claim steps are described in our Shipping & Warranty page.

7. Safety & Product Use

Products are intended for gardening use only.
Do not climb in or on planters. Do not allow children or pets to play inside or underneath planters.
Use the provided spanner only for tightening bolts and keep it out of reach of children.
Do not place rocks, plastic, or non-soil materials in the planter.
Do not add soil until the planter is in its final location; moving a filled planter can cause damage and may void warranty coverage.

8. SMS & Electronic Communications

By using the Site or placing an order, you consent to receive electronic communications related to your purchase (such as order confirmations, shipping updates, and policy notices).

SMS/MMS: If you opt in to receive text messages, we may send transactional and/or marketing texts. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP. For help, reply HELP or contact us via https://glplanters.com/contact-us/. Consent to receive marketing text messages is not a condition of purchase.

9. Product Availability & Descriptions

We attempt to be as accurate as possible in product descriptions, images, and pricing. However, we do not warrant that content is accurate, complete, reliable, current, or error-free. If a product is listed at an incorrect price or with incorrect information due to an error, we may refuse or cancel orders placed for that product.

10. Intellectual Property, Trademarks & Site Content

All content on the Site (including text, graphics, logos, images, video, and software) is owned by GL Planters or its licensors and is protected by intellectual property laws.

Trademark notice: GL Planters® is a registered trademark of Greenlight Planters, LLC (U.S. Patent and Trademark Office). Unauthorized use is prohibited.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our prior written consent.

11. Modification / Resale Prohibition

To protect customers and brand integrity, you may not resell GL Planters products on third-party marketplaces (including but not limited to Amazon, eBay, Walmart Marketplace, Etsy, Facebook Marketplace, or similar platforms) without our prior written permission.

You may not materially modify our products and resell them as “GL Planters” products, nor may you remove or alter branding, labels, instructions, or safety information.

12. Site Availability, Accessibility & Feedback

The Site may occasionally be unavailable due to maintenance, updates, outages, or technical issues. We do not guarantee that the Site will be uninterrupted or error-free. We welcome feedback, including accessibility-related feedback; please contact us via our Contact page.

13. Disclaimers & Limited Warranty Rules (Implied Warranty Carve-Outs)

Site and products provided “AS IS”: To the maximum extent permitted by law, the Site and products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limited Warranty / implied warranties: If you are a consumer and a written limited warranty applies, then to the extent permitted by law, any implied warranties are limited in duration to the duration of the applicable Limited Warranty.

Consumer rights / state law carve-outs: Some states do not allow limitations on implied warranties or the exclusion/limitation of certain damages, so some of the above limitations may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, GL Planters and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, loss of use, or loss of data) arising out of or related to the products, the Site, or these Terms, even if advised of the possibility of such damages.

Our aggregate liability for direct damages will not exceed the total amount you paid to GL Planters for the product(s) giving rise to the claim.

Important: Nothing in these Terms limits liability for death or personal injury caused by our negligence or for any other liability that cannot be limited or excluded by applicable law. Some states do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless GL Planters and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

16. Arbitration; Class-Action Waiver

a. Agreement to arbitrate. Except as set forth below, you and GL Planters agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of the Site (each, a “Dispute”) will be resolved by final and binding arbitration rather than in court.

b. Exceptions. Either party may bring an individual action in small claims court for disputes within that court’s jurisdiction. The arbitration requirement does not apply to claims for injunctive or other equitable relief necessary to stop unauthorized use of intellectual property or as otherwise required by applicable law.

c. Arbitration rules and forum. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. If AAA is unavailable, the arbitration will be administered by JAMS under its Consumer Rules. The arbitration will be conducted in Gwinnett County, Georgia, unless the parties agree otherwise. The Federal Arbitration Act and Georgia law (to the extent not preempted) will govern.

d. Class-action waiver. YOU AND GL PLANTERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

e. Opt-out. If you do not wish to be bound by this arbitration agreement and class-action waiver, you may opt out within 30 days of your first purchase by sending written notice including your name, address, and order number via our Contact page (select “Legal” and include “Arbitration Opt-Out” in the message) or by mail to: 2500 Northlake Dr, Suwanee, GA 30024. Opting out will not affect any other portion of these Terms.

f. Fees and remedies. The arbitrator may award any individual remedies available under applicable law. If you initiate arbitration, GL Planters will pay any filing fees in excess of the filing fees for a comparable civil action in state court, to the extent required by AAA/JAMS consumer rules and applicable law.

17. Dispute Resolution & Governing Law (Court Carve-Out)

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law rules.

For disputes not subject to arbitration (including small claims actions and intellectual property injunctive relief), you and GL Planters agree to submit to the exclusive jurisdiction of the state and federal courts located in Gwinnett County, Georgia.

18. Force Majeure

GL Planters will not be liable for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, severe weather, carrier disruptions, supply chain delays, labor disputes, governmental actions, outages, or other events of force majeure.

19. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will post updated Terms and revise the “Last updated” date. Your continued use of the Site after changes constitutes acceptance.

20. Miscellaneous

Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
No waiver: Failure to enforce any right is not a waiver of that right.
Entire agreement: These Terms, together with our Privacy Policy and posted policies, constitute the entire agreement between you and GL Planters regarding the Site and purchases.
